Hot Off The Press ...Piracy Lawsuit Actions.....
I have the original disc for every song I have and that's all I'm going to be concerned with. I have many original discs that I've purchased from other KJs going out of business. They were all legally purchased at one time. If anyone made copies of the discs before they sold them, they would be the law breaker.
After you join the "Karaoke Club"...you agree to let them inspect your hard drive.
They are not going to look a each and every song disc by disc.
There are specific songs they will look for.
These songs are songs that had a very short production life. The discs were pulled off the market. Recalled. The reason for the short run...being they never had proper permission to use these songs for karaoke.
So yes they are looking for illegal songs on your hard drive.
THEY ARE LOOKING FOR THE SONGS THEY USED ILLEGALLY.
So you will be "guilty by association"..... association of known pirates. Sound Choice being in the lead followed by all the other companies that used and released songs they had no permission to use.
If you have a questionable disc, just intermingle the tracks with known legal discs. Change the disc/track designation and it will get lost.
I do not see how they can use illegal songs to convict anyone of using illegal songs.
Your Honor.....I counterfitted these $75 bills and they stole them from me and used them ...arrest them .....make them stop.
There is no Honor amoung thieves.
I'm not saying piracy isn't wrong...but the traps/evidence being used aren't legal. Using a "good" crook with a badge to catch the "bad" crooks.
If the publishers wanted to get smart and make a lot more money, they would convince all the artists to let their songs be used for karaoke. This would have the same effect on sales as Michael Jackson's death. It will reintroduce a whole new generation/crowd to their music all over again. Increasing demand. That means making more MONEY. The writer makes more money and the musicians make more money and the producers make more money and the government makes more money and the karaoke sites make more money and before you know it the economy boo boo will be all better.
The tracks are already laid down. Remove the lead vocals and do the word sweeps. You will iliminate the middle man and sell more of your music. Taylor swift is going to be the richest artist down the road. She is already doing it with her albums. Way ahead of her time.

http://en.wikipedia.org/wiki/Trademark
Trademark includes intellectual property language.

In the overview section....they have the legal right to control "reproduction."
At first I thought they wouldn't be able to win. Because a Trademark is used as way to indentify a product.
A Trademark infringement usually means someone is using your name or the way you write your name (logo) to indentify your product or service as their own. Pirates are not claiming they are Sound Choice or they actually wrote the music or made the word sweeps. They are just playing their music without making claim of ownership of the Sound Choice disc/music or logo.
The right to control reproduction is their hand. The pirate doesn't have the permission to reproduce the disc. That is the Trademark violation.

The pot just got bigger.
See at one point they were offered a settlement of $5000. Dahhhh...I want that guys lawyer....
He knew he was guilty and he knew they knew and had the proof. STUPID..he paid his lawyer more than $5000. For nothing.
I don't think filing bankruptcy after the fact gets him out of paying the fine.

This is the law used in these cases.

If they would conduct a "raid" of your property....every copy will be used as evidence of your illegal activities. They could say that you are in the business of selling loaded drives. Look your Honor, we have the evidence. Multiple copies of hard drives.
I have about 8 back ups. I'm not taking any chances with my investment.

In this country we're still innocent until proven guilty. Possessing multiple copies of your karaoke music hard drive is not proof that you are selling them. You could simply be a very careful person who wants to thoroughly protect your investment. Say you have one backup hard drive with you in case of failure and the original does fail. You now have only one hard drive. What if something happens to it on the way home like from an auto accident or theft. Your screwed.
So it seems logical that a person would want multiple copies. Two that are always with you on the job, one at home, maybe one in a safety deposit box at your bank, and any other safe places you can think of. The bottom line is that only one of them is in use at any given time.
